Thank you for choosing KristinaJ Captures for your photography needs. By booking a photography session, submitting a booking request, paying a deposit, or otherwise agreeing to receive photography services from KristinaJ Captures, you acknowledge that you have read, understood, and agreed to the following Terms & Conditions.
These Terms & Conditions are intended to establish clear expectations between KristinaJ Captures and its clients while protecting both parties throughout the photography process.
Photography Services
KristinaJ Captures is a privately owned, locally operated photography business providing photography services based on the session selected by the client.
Photography services may include, but are not limited to:
Portrait photography
Group photography
Family photography
Automotive photography
Event photography
Creative or themed photography
Seasonal photography
Other individually agreed-upon photography services
The specific services provided will be based on the session or package selected at the time of booking.
KristinaJ Captures reserves the right to determine the creative approach, photography techniques, composition, posing, lighting, location considerations, and artistic style used during a session.
Booking & Confirmation
A photography session is not considered officially booked until the required booking information has been submitted and the required security deposit has been received.
The security deposit is only accepted at the time of scheduling and is required to secure the client's selected date and time.
Submitting a booking request does not automatically guarantee the requested date or time. Your session is confirmed only after KristinaJ Captures has accepted the booking and received the required security deposit.
Clients are responsible for providing accurate contact information and booking details.
Security Deposit
A security deposit is required to reserve and secure your scheduled photography session and is collected only when scheduling the booking.
The security deposit helps reserve your specific date and time and compensates the photographer for holding that appointment exclusively for the client.
If the client provides a reasonable cancellation with at least 48 hours' notice, the security deposit may be refunded and the client may have the option to reschedule, subject to availability.
If a client cancels less than 48 hours before the scheduled session or fails to attend their scheduled session without appropriate notice, the security deposit may be forfeited.
Payment of the security deposit acknowledges that the client understands and agrees to the cancellation and rescheduling policies outlined in these Terms & Conditions.
Cancellation Policy
Clients must provide at least 48 hours' notice if they need to cancel their scheduled photography session.
Reasonable cancellations made 48 hours or more before the scheduled session may be eligible for a refund of the security deposit and may be rescheduled, subject to availability.
Cancellations made less than 48 hours before the scheduled session may result in the loss of the security deposit.
If a client does not show up for a scheduled session without providing notice, the session may be considered a no-show, and the security deposit may not be refunded.
Repeated cancellations or no-shows may require a new security deposit before another session can be scheduled.
Rescheduling
KristinaJ Captures understands that unexpected circumstances may occur. Clients are encouraged to communicate as soon as possible if they need to cancel their scheduled session.
Rescheduling is available only in connection with a cancellation and is subject to photographer availability.
Reasonable cancellations made at least 48 hours before the session may be eligible for both a security deposit refund and the option to reschedule.
Cancellations made less than 48 hours before a session may result in the loss of the security deposit and may require a new deposit to reserve another date.
KristinaJ Captures will make reasonable efforts to work with clients when unexpected circumstances occur, but rescheduling is not guaranteed.
Payment for Services
Clients are paying for the photography services provided by KristinaJ Captures, including the photographer's time, experience, creativity, artistic direction, originality, photography equipment, editing, professional services, and final photographic products.
The price of a photography session reflects more than the time spent taking photographs. It also accounts for preparation, communication, travel when applicable, equipment, photography expertise, creative decisions, editing, organization, and delivery of the final product.
The remaining balance, if applicable, must be paid according to the payment terms provided when booking.
Accepted payment methods may include debit card, Cash App, and Apple Pay, unless otherwise stated.
Creative & Artistic Control
Photography is a creative and artistic service. Clients are encouraged to communicate their preferences, ideas, inspiration, and expectations before and during their session.
However, booking a session does not guarantee that every photograph will look exactly like a reference image, inspiration photograph, social media post, editing example, or client's personal expectation.
KristinaJ Captures retains creative control over the photography process, including:
Composition
Lighting
Camera settings
Angles
Posing
Photography techniques
Image selection
Editing
Color grading
Cropping
Artistic style
Final image presentation
Reference photographs may be used for inspiration but are not guaranteed to be recreated exactly.
Client Satisfaction & Disagreements
KristinaJ Captures wants every client to have a positive experience and receive a final product that they are happy with.
Because photography involves personal taste and artistic interpretation, there may occasionally be differences between a client's expectations and the photographer's artistic result.
After the finished product has been received, the client has 72 hours to communicate any questions, concerns, or dissatisfaction regarding the delivered photographs.
If a client is dissatisfied with their final photographs, they are encouraged to communicate their concerns respectfully within this 72-hour period.
KristinaJ Captures may discuss reasonable options with the client in an effort to reach a fair compromise. Depending on the circumstances, possible options may include a reasonable edit adjustment, clarification of the client's concerns, or another mutually agreed-upon solution.
However, dissatisfaction based solely on personal preference, the photographer's artistic style, posing, lighting, composition, or other creative decisions does not automatically qualify the client for a refund, free reshoot, or replacement of the entire gallery.
Major concerns and minor concerns will be evaluated individually and based on the circumstances of the session.
Editing & Retouching
Editing is an important part of the photography process and is included according to the selected photography package.
KristinaJ Captures will edit images according to its established artistic style unless specific editing preferences have been discussed and agreed upon beforehand.
Basic editing may include adjustments to exposure, color, contrast, cropping, sharpness, and other standard adjustments.
There is no additional fee for extensive editing or retouching when such editing is agreed upon as part of addressing a reasonable client concern or as part of the photography service.
KristinaJ Captures is not required to provide unedited RAW files unless specifically requested and paid for as an additional service.
Final Image Selection
Not every photograph taken during a session will be delivered to the client.
Images may be excluded because of:
Blinking
Unflattering expressions
Motion blur
Poor focus
Duplicate images
Test shots
Lighting issues
Equipment limitations
Other technical or artistic considerations
KristinaJ Captures has the right to determine which photographs are selected for the final gallery.
Delivery of Photographs
Final photographs will be delivered through the delivery method chosen or agreed upon by the client and KristinaJ Captures.
Estimated delivery times may vary depending on the type of session, workload, number of photographs, editing requirements, holidays, equipment issues, or unforeseen circumstances.
KristinaJ Captures will make reasonable efforts to deliver photographs within the communicated timeframe but does not guarantee an exact delivery date unless specifically agreed upon in writing.
Clients are responsible for downloading and safely storing their final photographs after delivery.
Copyright & Ownership
Unless otherwise agreed in writing, KristinaJ Captures retains the copyright and ownership rights to photographs created during a session.
Purchasing a photography session or receiving digital photographs does not transfer copyright ownership to the client.
Clients receive permission to use their delivered photographs for personal purposes, such as:
Personal social media
Personal websites
Printing for personal use
Sharing with friends and family
Commercial use, resale, publication for business purposes, advertising, or other commercial use requires written permission from KristinaJ Captures and may require an additional licensing fee.
Clients may not sell, license, or commercially distribute photographs without written permission.
Photographer's Portfolio & Marketing Use
Unless the client has specifically opted out or another written agreement exists, KristinaJ Captures may use photographs from a session for legitimate business purposes, including:
Website portfolios
Social media
Advertising
Marketing materials
Photography samples
Promotional materials
If a client has concerns regarding the use of their photographs, they are encouraged to communicate those concerns before the session whenever possible.
Client Responsibilities
Clients are responsible for arriving prepared and on time for their scheduled session.
Clients should communicate important information that may affect the session before the appointment.
Clients are responsible for:
Arriving at the agreed location on time
Bringing necessary clothing, props, or personal items
Following reasonable photographer instructions
Informing the photographer of relevant session preferences
Ensuring children and guests behave appropriately
Obtaining permission for any location requiring it
Treating the photographer and equipment respectfully
The photographer may end a session if the photographer experiences harassment, threatening behavior, unsafe conditions, intentional damage to equipment, or other serious misconduct.
Late Arrival
Clients are encouraged to arrive at least a few minutes before their scheduled start time.
Late arrival may reduce the amount of time available for photography. Unless otherwise agreed upon, the session will generally end at its originally scheduled time.
A late arrival does not automatically entitle the client to additional photography time, a refund, or a rescheduled session.
Locations & Travel
The client and photographer will agree upon a location before the session whenever possible.
Clients are responsible for communicating any location restrictions, permits, fees, parking requirements, or other relevant information they are aware of.
If the selected photography location is one hour or more away from KristinaJ Captures, the client will be responsible for the photographer's transportation costs associated with traveling to and from the location.
Any applicable transportation costs will be communicated to the client before the session whenever reasonably possible.
Weather & Unforeseen Circumstances
Outdoor photography can be affected by weather and environmental conditions.
If weather or another circumstance creates an unsafe or unreasonable environment for the session, KristinaJ Captures may recommend cancellation and rescheduling.
Examples may include:
Severe storms
Lightning
Dangerous weather conditions
Unsafe travel conditions
Natural disasters
Location closures
Other circumstances outside the photographer's reasonable control
When possible, KristinaJ Captures will work with the client to find another suitable date.
Photographer Illness, Emergency, or Unavailability
If KristinaJ Captures is unable to perform the scheduled session because of illness, emergency, equipment failure, or another circumstance outside the photographer's reasonable control, the photographer will make reasonable efforts to reschedule the session.
If rescheduling is not possible, the client may be entitled to a refund of amounts paid for services that were not provided, subject to the circumstances.
Equipment & Technical Issues
Professional photography involves technical equipment that may occasionally experience unexpected problems.
KristinaJ Captures will make reasonable efforts to protect photographs and maintain functioning equipment.
If a technical issue results in the complete or substantial loss of a session, the photographer will work with the client toward a reasonable solution, which may include a rescheduled session or other mutually agreed-upon remedy.
Safety
The safety of the client, photographer, assistants, guests, and equipment is a priority.
KristinaJ Captures may refuse or stop any photograph, pose, location, activity, or request that the photographer reasonably believes presents a safety risk.
Clients are responsible for their own personal belongings and personal safety during the session.
Children & Minors
A parent or legal guardian must provide permission for photography involving minors when required.
Parents or guardians remain responsible for the supervision and behavior of children during photography sessions.
Guests & Additional Participants
Clients should communicate in advance if they intend to bring additional guests or participants to their session.
Additional participants over three years of age may require an additional fee, depending on the photography package and number of participants.
Children three years of age or younger will not incur an additional participant fee.
Additional people may affect the session's timing, posing, location, or final photographs.
KristinaJ Captures reserves the right to limit additional participants when necessary to maintain the quality, safety, or organization of the session.
Personal Belongings
KristinaJ Captures is not responsible for lost, stolen, or damaged personal belongings brought to a photography session.
Clients should keep valuable personal items secure throughout the session.
Respectful Conduct
KristinaJ Captures is committed to providing a professional and respectful environment.
Harassment, discrimination, threats, intimidation, abusive behavior, inappropriate conduct, intentional damage to property, or other unsafe behavior will not be tolerated.
KristinaJ Captures reserves the right to end a session without completing the remaining scheduled time when serious misconduct occurs.
Independent Business
KristinaJ Captures is a privately owned, locally operated photography business and is independently operated.
Photography services are provided directly by KristinaJ Captures unless otherwise communicated to the client.
Changes to Services & Pricing
KristinaJ Captures reserves the right to update photography packages, services, prices, policies, and offerings at any time.
Changes will generally apply to future bookings and will not retroactively change an agreement that has already been confirmed unless otherwise agreed upon by both parties.
Agreement to Terms
By submitting a booking request, paying a security deposit, making a payment, or participating in a photography session, the client acknowledges that they have had the opportunity to review these Terms & Conditions and agrees to comply with them.
These Terms & Conditions, together with any written agreement, invoice, booking confirmation, or package details provided to the client, constitute the understanding between KristinaJ Captures and the client regarding the photography services.
Questions & Concerns
If a client has a question, concern, or disagreement regarding their session or final photographs, they are encouraged to contact KristinaJ Captures directly so the matter can be discussed professionally and, when reasonably possible, resolved through a mutually acceptable solution.
KristinaJ Captures values its clients and will make a good-faith effort to address legitimate concerns fairly while maintaining the artistic integrity and standards of the business.
Client Acknowledgment
By booking a session with KristinaJ Captures, I acknowledge that I have read, understood, and agree to the Terms & Conditions outlined above, including the 48-hour cancellation policy, security deposit requirements, payment terms, creative and artistic control, copyright provisions, client responsibilities, 72-hour concern period, and policies regarding dissatisfaction or requested changes.
